RENTAL AGREEMENT
Thank you for selecting Casa Claudio. As with any property agreement there are basic terms and conditions all parties should understand. Please review terms and conditions outlined and sign below to acknowledge your understanding and agreement. Please email the completed agreement to [email protected]. 1. RATES: Advertised rental rates are based on a minimum of (1) nights with arrival time after 3:00PM and departure before 11:00AM. Payments may be made by credit card, check or money order. Checks and money orders can be mailed to Danielle Claudio, 1216 Highcrest Lane, Colorado Springs, CO 80921. Checks will only be accepted 60 days prior to arrival date.
2. PAYMENT/CONFIRMATION: A reservation is considered confirmed upon Owner receipt of the Rental Agreement signed by the Guest and a confirmation payment which consists of either the full deposit or Total Rental Payment. Deposit, Rate, Fees & Tax payments can be made via VRBO.com, AirBNB.com, www.casaclaudiofl.com, www.casaclaudioaz.com, casaclaudiovacations.com or by personal check or money order. Any online method is the most convenient and easiest way to pay your security deposit with a credit card and be quickly refunded upon departure. If paying by check or money order, a Confirmation Payment must be received within five (5) days after your reservation has been made, if payment is not received, then the reservation shall be canceled and dates of stay released.
3. FINAL PAYMENT: A Final Payment, consisting of the balance of the Total Rent Payment, Fees, Taxes and the Security Deposit, is due (60) days prior to the arrival date. For last minute reservations, personal checks will NOT be accepted. If your reservation is made within 60 days of your stay, full payment is due at the time of booking.
4. ARRIVAL: Please plan to arrive after 3:00 PM on your first date of occupation. You will be provided with an electronic key or passcode, your key access will be sent to you via email with directions on how to unlock the front door. If not, a house key will be provided. We will also provide a key to the pool areas. Please inspect the house carefully. Damages found should be reported within 24 hours of arrival. We are usually unable to accept requests for early arrivals but may be able to do so under some circumstances.
5. CANCELLATIONS: If it is necessary to cancel reservations, please notify us as soon as possible. If you cancel 7 days or more before your arrival date, you will be refunded 50% of the money you paid minus a $250 processing and marketing fee. There will be no refunds for cancellations within 6 days of your arrival date, including early check outs, no-shows or inclement weather. Traveler insurance can be purchased and is highly recommended. Please contact your preferred insurer.
6. GUEST RESPONSIBILITIES: Guests accept responsibility for and agree to abide by the terms and conditions contained herein, and all requirements and instructions delineated in the DEPARTURE PROCEDURES. Our neighbors appreciate the QUIET nature of this development and we require that all Guests abide by our communities wishes.
7. PETS ARE FORBIDDEN: (unless approved prior by owner) and will result in eviction and forfeiture of all monies.
8. NO SMOKING: Any guest violating the owner’s No Smoking rule may cause all guests to be evicted with forfeiture of all monies paid. Smoking includes cigarettes, cigars, pipes, etc. If our inspection or housekeeper detects at departure the presence of smoke or cigarette butts, the full security deposit may be forfeited.
9. OCCUPANCY: Our rental rates are based on a maximum of 6(Scottsdale) or 10(Kissimmee). Children are counted in total occupancy. OVER OCCUPANCY IS CONSIDERED A SERIOUS VIOLATION OF YOUR AGREEMENT and we will deny access or have the premises vacated with NO refund of monies.
10. FAMILIES ONLY: This is a family Friendly residence and our desire and preference is to rent to couples and family groups. We do not rent to fraternities, sororities or other similar groups, or groups of persons less than 25 years of age. We reserve the right to require official picture identification showing date of birth of each occupant and/or guest.
11. UTILITIES: Utilities are included in your rental rate. Please remember during your stay to turn off lights and ceiling fans when not in use, and always lower the air conditioning when leaving the house. Reservations in which the set utility limit is exceeded, the difference may be deducted from the security deposit.
12. SUBLETTING: Guests shall not assign or sublet or grant any concession or license to use the house or any part of the property to another party.
13. DAMAGES: Guests making the reservation shall be liable for any and all damages to the house and its contents. The property is well maintained and clean, however, just like your own home, unexpected breakdowns can occur. All efforts will be made to correct any problems you might experience in a timely manner, however, refunds cannot be made. Any damages made by the guest/s will be assessed and the total amount of damages will be paid for by the Guest from their deposit. If the total amount of damages exceeds the total of the deposit paid, the remaining balance will be paid for by the Guest to repair the damage.
14. INDEMNITY: The Guest will indemnify and hold harmless the Owner and the agents of Owner from any and all damage, loss, expense, claim, action or liability of any kind whatsoever, or howsoever caused including, without limitation, a claim of any kind by any member of the Guest party (including those of minor children), which arises from or relates in any way to the use or occupation of the property by the Guest, members of the Guest party or by invitees of the Guest. The Guest is responsible for any damage of any kind to the property caused or contributed to by the Guest, members of the Guest party or by invitees of the Guest. The fact that children are permitted on the Property does not imply that the Property is without risk to children.
15. INSURANCE: Vacation and trip interruption or cancellation insurance is available from many insurance carriers and is highly recommended for guests to consider for protecting their investment. 16. ITEMS LEFT BEHIND: The Owners shall not be responsible for articles left in the house or theft of any kind. If a guest requests us to attempt to locate and mail any forgotten articles, we will make a good faith effort to return any items (see Departure information).
17. PARKING: One parking spot is available for your use. Parking areas are for automobiles only. RVs, travel trailers, boat trailers, etc. are not permitted.
18. ROUTINE REPAIRS: It may be necessary for us to enter the house during reasonable hours (8:00AM to 5:00PM) to service equipment or to perform minor repairs. Notice may be provided, should this be necessary.
19. SECURITY DEPOSIT: Reservations require a minimum $500 refundable security deposit with your final payment. The Deposit will be refunded within 7-10 business days of your departure, provided there is no damage, the unit is left in a basic-clean condition, and all property used, including keys, have been returned.
20. PHONE: This property is equipped with a telephone for your convenience and safety. Please do not abuse this privilege by charging long distance calls to the phone. Should a toll call appear on the telephone bill for dates a Guest was in the house, then the amount of the calls plus a $25 service charge will be deducted from the Security Deposit.
21. DEPARTURE: Please plan to leave the house no later than 11:00AM on your departure date. Guests are responsible for maintaining and leaving the house in a CLEAN, NEAT and UNDAMAGED order as described below in DEPARTURE PROCEDURES. For the convenience of guests, the house has cleaning items (vacuum, broom, mop, bucket, etc.) and a small quantity of cleaning supplies for spills and small messes. Please note that if any house work over and above the routine setup/preparation is necessary, a fee will be made against your Security Deposit. We will make a good faith effort to return any items left behind, but we shall not be responsible for your items left in the house, so please check closets, dresser drawers, etc. for personal belongings. Please take good care of the house during your stay, as you would your own home.
22. DEPARTURE PROCEDURES (a) Dispose of all trash; please be sure to deposit plastic liner before placing in trash can. (b) Rinse all dishes and place them in the dishwasher; run the dishwasher. (c) Remove all trash, perishable food, personal goods, newspapers, magazines and any other local promotional brochures or sales literature, etc.; (d) Return all household items, equipment, furniture, and porch equipment to original locations and configurations; (e) Place all used bed linens and towels in the washing machine and start the machine! (f) Close all blinds, and secure and lock all doors and windows. (g) A rental representative will arrive the day of your departure to collect all keys. In advance, we thank you for your assistance and cooperation, particularly on the behalf of our guests who will follow you!
22. VISITING GUESTS: Guest(s) are allowed for NO longer than 6 hours. Over occupancy is a serious violation of the lease, and the owners reserve the right to deny access or to have the premises vacated with no refund of monies.
